California Drunk Driving Law (2003) out-of-print - not for saleby Josh Dale and Ed Kuwatch2003 Historical Brochure Here - This Book Not for Sale ~ this is a working document ... ![]() The history of California Drunk Driving Law is a long one - the book and the subject. It really begins in the late '60's. There are a few court cases about drunk driving, but not many. Prior to 1931, there was no breath test - Rolla Neil Harger (1890-1983) invented the Drunkometer in this year. Breath testing only got started about this time and mainly in New York and a few other states. California courts simply accepted that it worked about 1975, and to this day, no California court has examined breath testing and whether it is precise and accurate just like blood testing (which still has a .01% error level at .10% and above BAC levels) - California prosecutors and jurists don't care because the Legislature says they don't have to care. Back then in the late '60's, not only did our blood alcohol level used to be .15%, routinely people were escorted home by police officers who helped these people out rather than like now, arrest everyone - even if below the limit.
Keep in mind, the limit dropped to
.10% because at that point, all scientists agreed that that is the
point when all
persons are under the influence of alcohol - even alcoholics and people
"who can drink."Well, Ed Kuwatch began a book in the '80's called California Drunk Driving Law, or CDDL as we attorneys know it by. His entire day of work was put into this book from his Mendocino County home in the Redwoods. He networked with attorneys around the state and soon his book became the number one hit with attorneys in California - and really it was because he was all-inclusive. He believed in helping all the California attorneys learn, especially the public defenders, who, unfortunately, defend most of the DUI cases. This was especially so and In 1990, California was a .08% State, and we had the new DMV system in place, and Ed's book hit the ground running - attorneys from all aspects of the law bought his book since it was the "Bible of DUI Defense." Throughout the '90's California Drunk Driving Law maintained its position as the practice guide by the "guru" of DUI defense. Well, as the '90's came to a close, and Ed was aging, the book was put up for sale. In about 2002, James Publishing bought the book from Ed Kuwatch. In 2003, Josh Dale took California Drunk Driving Law into its new format and update - Hutton & Wilson then joined the team, and new authors now have the work. ![]() A hot book on the market right now in California DUI law is this one, Attacking and Defending Drunk Driving Tests, by Donald Bartell and the late Anne ImObersteg.
