What to do after a California DUI arrest

In California, the DUI laws are tough - so begin your research after getting you vehicle out of impound - this will save you the most money. Try not to have to post bail - it is usually a waste of money too. Don't race out and hire the first attorney you're recommended either. Check them out online first and don't get dazzels by sales pitches.

Get some rest ... you've been through one of the most stressful things you can go through - detention, search, arrest, booking and testing(s). I know you have not had things explained well enough and I need you to be wide awake when we talk. If you're not sober - get that way - they may require you go in for testing while your cases proceed.

Understand next that if you don't fight to save you license - it is automatically suspended. You (or preferably me) must demand a DMV hearing by the 10th day after arrest or your right to drive in California is gone and without a fight. Call me to discuss this because there are rare exceptions that work to save your license.

For both the DMV and the court case, I need you to tell me what you did for the 24 hours prior to arrest, search, and testing. What did you do, where did you go, what did you eat, drink, participate in? Why did the cop pull you over, what did the cop say after approaching you - did you remain silent and hand over the "bust card"? Are you ill or on a special diet?

I begin my interview with you on the phone or by email/SMS. You are not necessarily going to jail unless you are facing your 2nd, 3rd, or 4th or more offense. If it is your first offense DUI, and your crashed your car, or people were injured or killed, easily you could get jailtime or state prison. My job is to keep you out of jail, driving legally, and working at your job.

I believe in getting an attorney in the area that you are charged in court - so I handle cases mainly in the counties I've enumerated on my pages. I am most experienced because I have no fear of the system - I took my own case to the Supreme Court and if your case deserves it, I'll fight for you to the Supreme Court too.

You are about to receive letters in your mailbox - you might receive email too - all of this from soliciting attorneys - BEWARE - I am much more experienced in this type of criminal law than these lawyers - BEWARE -  if your case is a loser, I'm going to charge you a low fee as opposed to a winner case that might be for more time on my part. Call me to discuss your case after you get a little sleep.

BEWARE - only you should contact the DMV (or the attorney you hire within 10 days) - don't allow any lawyer or representative of a law firmnotify DMV for you - it is just a ploy to get your money whether or not you need the law firm.

Lastly, only get a lawyer who is associated with the California DUI Lawyers Association - no other association of DUI attorneys represent California DUI attorneys (and through them, their clients).
